I don't title insurance cares about CC&Rs. If there was a lein against the house from a previous owner, then the title insurance would let you know.

I think the builder/developer can do whatever they want. I've only looked up a few on the Madison County Probate website. All CC&Rs were run by the developer until all of the units in the subdivision were sold. Then the residents could form a HOA and do whatever.

In my fiancé’s neighborhood, the CC&Rs are in effect for 25 years and run by the developers. At the end of 25 years, if a majority of the homeowners vote yes, the CC&R stays in place. Suffice to say, the developers haven't done anything since they built the subdivision. But technically, the neighborhood has a CC&R.
