The bank doesn’t own it just because they have a security interest in it. As long as you’re paying, the house is yours. If you sell the house for a profit, do you have to share the gain with the bank? No, because the bank wasn’t an investor in your property, they were a lender.

I have a SFH with a detached 2 car garage on a pretty good size lot.

If they are giving me $100k to go towards building an apartment above the garage, in exchange for 10 years of income restricted rentals, I would do it. Easy enough to find someone in their 20s to rent to.

I don't know what a governor could legally make you do with your own property and I hope we don't find out.
You want an illegal living on your property? If you can live with that do you trust a govt who would make you take anyone in to continue whatever subsidies they claimed they will give you? Take your tax credits and pay for security for your kids.

I assume you would be able to rent to whoever you want to. Not sure what illegals have to do with any of this.

Just looked it up and 80% of the median income would be $67k a year in Bergen county. Would be easy to find someone responsible making under that amount. Especially if it means they get rent that’s below market price

Why? Do you know of some other program where you can’t select your own tenant? Even landlords who accept Section 8 tenants can be selective so long as they’re not being discriminatory. Besides, this is the type of thing that would be disclosed to someone before handing them $100,000.
