I'm in need of some advice. To put a long story short I am aware of ND labor laws. Employers are not required to allow you a break other than a meal break of 30 minutes if the employee works 5 hours or more. Also, there are no requirements to provide employees of any policies or conditions of employment. With that being said I acknowledge I was in the wrong by telling my boss I needed a break and walking away. I never walked home or off the jobsite completely. I walked away from my employer. My employer is the one who took the initiative to send another worker to me in the work truck and tell me I’m going home. I took measures to reach out to my employer to ensure that my job wasn’t at risk. In the stage of life I am at now I would never quit a job without having another job lined up. This summer, before my herniated disc injury, I was given a raise. I went from $18/hr to $23.25/hr. This is a significant wage increase. I believe the under performance I had the past two months are what the deciding factor were for my employer to let me go. I was also let go the week before our annual yearly bonus. I disagree with the statement that I voluntarily quit as if that was the true case, I would still have my job and working for this employer.

I have been denied UI benefits their reasoning: YOU STOPPED REPORTING FOR WORK. THE EMPLOYER HAS NOT HAD ANY COMMUNICATION
FROM YOU OR YOU DID NOT RESPOND TO INFORMATION REQUESTS SENT TO YOU BY JOB
SERVICE.
TO BE ELIGIBLE FOR BENEFITS IN A QUIT YOU MUST SHOW THE REASON YOU LEFT THE
EMPLOYER WAS GOOD CAUSE ATTRIBUTABLE TO THE EMPLOYER. IN ORDER TO ESTABLISH
GOOD CAUSE FOR LEAVING, YOU MUST SHOW THE EMPLOYER SAID OR DID SOMETHING, OR
FAILED TO DO SOMETHING THAT WOULD CAUSE A REASONABLE PERSON TO LEAVE THEIR
EMPLOYMENT.
AFTER REVIEWING ALL THE INFORMATION PROVIDED, WE FIND YOUR REASON FOR LEAVING
WAS WITHOUT CAUSE OR FAULT ON THE PART OF THE EMPLOYER.
BENEFITS ARE DENIED.

I called and texted him the same day this all went down and have proof. My case is now in appeals and Im waiting for a hearing date. Any advice to help a guy out?

Put this situation behind you. There is plenty of work in North Dakota, especially for the spring and summer. Move on.
