I am trying to help my sister, her father was an American soldier unknown name. Mother was or is Irmgard Katherine Schwientek. She was adopted by a military family and raised in USA has been here for 45 yrs. Division of motor vehicle has now after all these yrs declared her an Alien and said they will have her deported by imigration to Germany with nothing but the clothes on her back and 50.00. She doesn’t care if they don't want to make connections. The problem is now DMV will not accept her translated birth certificate they say she needs contact with mother or father and to get a birth certificate from Germany. Or the agency that handled adoption She has worked here, schooled here, married here and has 2 children and 3 grand children here. They now say anytime they can pick her up at anytime. She has been hospitalized over all this. She was issued everything any American has been given, passports, driver’s license, marriage license. Now they tell her she must have gotten a forged one, even though on DMV record and paid federal taxes. Time is running short if anyone has a suggestion, help anything would be appreciated.

That doesn't make sense. DMV has no power to deport someone, and her original German birth certificate is useless in proving U.S. citizenship. If she was adopted by U.S. citizens she should have been issued a new U. S. birth certification she should have naturalization papers. You need to (1.) Ask your parents if they have her proper documentation, and (2.) contact an immigration attorney.
I know we were shocked when we found out how much power DMV has. We are in Va. SHe was issued a US birth certificate. It was traslated to english. That is the only birth certificate she recieved. She was adoted when she was 2. We checked into an attorney. They want 10k just to startm does not included 6k in paperwork filing and any German detective or searcher that might be needed. All she did was let her license expire by 1 day. and we to renew. It has been renewed all these years! The all the sudden DMV said she is an alien and must have gotten a false license somehow. She should them her school records where she took drivers ed. They just told her that she would be turned into immigration

Isn't that true most anywhere but DMV here in VA turned her into immigrationm when she went to renew here Drivers license that she has had since 15yr8mo old,She even should them her drivers ed from school

The US birth certificate from an agency in NJ handled the adoption. Then through the years she also has had a passport! THat was revoked when DMV flagged her an Alien. She was issued a passport , Drivers license , has all her school records . She was married here, lived in FL where she was issued FL drivers license, all these things any of us could have or get. She just let license expire by one day and went in to get it renewed and they laid all this on her. The attorney thing that is just too much at 10k up front just to begin.
You really need to talk to a local immigration attorney. It's impossible to help you online without all the facts, and the story is rather confusing. Call around for a more reasonably-priced one. You need someone to look over her documents and to represent her at the deportation hearing, if it comes to that. Is she still married? (To a US citizen?) Does she have a Social Security number? Who revoked her passport? Has the Dept of Citizenship and Immigration contacted her?
Could it be that her copy of her BC is not an official copy signed and stamped by the registrar? That would be a simple process of ordering one from NJ, where it was issued. Does she have her Certificate of Citizenship? (should have been issued by the Dept of State at the time of adoption) Are your parents still living? They might have her original documents, if she doesn't.
You mentioned a "translated birth certificate" but if she was issued a US certificate in NJ, it would be issued in English with her adoptive parents' names. If she went to DMV with a copy of her original German birth certificate, that may have caused the confusion. And they may have been telling her she needed to get an original - meaning an official -US copy, not that she needed her original German copy. Because the bottom line is, she needs to prove she was adopted by US citizens and is therefore a US citizen herself. School records aren't good enough (non-citizens can go to school in the US). She needs her certificate of citizenship and/or a stamped copy of her US birth certificate.
Does she have a Social Security number? If so, she had to provide proof of citizenship to get it (unless she got it as an alien). The Social Security Administration will have the records. Have her call the SSA 800 number to get the ball rolling on securing proof of American citizenship.
AND, nobody is going to deport her unless there is something more to the story.
