Maybe they are not NAR members. So no NAR policy was violated.
I did find it curious that the ftc says that on the mls is best way to sell properties for sale knowing about the doj and the multiple commission lawsuits with the NAR.
It's a violation of my local MLS rules as we aren't allowed to market them until they get listed. No coming soon or any of that, not even a sign in the yard more than 24 hours ahead of going in MLS.
We are NAR-Compliant, REALTOR Association-owned MLS in the Triangle MLS.
It is not mandatory to enter a listing into the MLS if the owner declined MLS entry and marketing. We have a TMLS document specifically for this purpose.
Since OpenDoor is brokerage is selling OpenDoor stuff, they would qualify for use of this option.
The article is laughable. "To avoid price negotiation and bidding wars... etc..."
All they want to do is remove buyers agents from transactions so they can screw unrepresented buyers.

Assuming the are NAR members that is what will need to be decided. Can you sell your own home (being licensed and a Realtor) before you offer it to the public or do the MLS rules overrule the situation. Especially when you already have thousands of your own homes already in MLS systems. It's not like this is a 1 time Agent sale going on the market.

I can legit market and sell my house without entering it into the MLS.

It's not just NAR. If you are an agent working under a broker, the broker may have an office policy regarding whether you as an agent can "FSBO" your home, sell it privately (without advertising to the public) or must list it in the MLS offering a co-broke.
Yeah if that partnership doesn't give agents pause, I don't know what will.
The only thing that will get agents' attention is if they notice a great reduction in contacts from Z.
What I see is a desperate attempt by two failing companies to find a nickel or two in the cushions.
