I think that's a real tornado. Too well defined to be a dust devil - just my opinion.

Anyone know where that picture was taken?

Here is a link that explains it a bit better. It was taken on May 8, 2008 and is a real picture. It is described as a landspout....it is a tornado but a type which can start from the ground up. They are not common but can occur from non-severe thunderstorms when certain wind shear conditions are present near the ground. It isnt quite a dust devil per se...as dust devils are not as vertically developed...but it isnt a typical tornado either which usually forms on the backside of a supercell thunderstorms. These landspouts are often weak and very short lived.

I *think* this is a video of that tornado (err...landspout). The video footage was taken by the same storm chaser, Jim Reed. And, it certainly looks like the same one to me.
