Unless you're getting the apartment upgrade from the same LL, why would they let you out without a penalty? The LL didn't force you to have more kids.

I believe the law is 250 sq ft per person, so typically 2 people in a studio, 3 in a one bedroom and 4 in a 2 bedroom.

On a more somber note, many people have died in fires over the years to bring us these codes. Good to look into why there are certain codes.

I believe it is fine in most towns if there is at least 750 sq ft in the one bedroom apartment.

But coming from Acton, I'm not exactly a Brookline expert, so I would go to the the town's website or call the town to find out what the definite rules are.

I am pretty sure that you would need two bedrooms for a couple with a child. However if I am mistaken, please post so we can all learn.

What size unit is appropriate for my household?
The BHA is required to follow certain occupancy standards that limit the number of residents according to the number of bedrooms. The following is a basic guide (exceptions follow):
family size/ eligible for:
1 person/ 0-1 BR
2 people/ 1-2 BR
3 people/ 2-3 BR
4 people/ 2-4 BR
5 people/ 3-5 BR
6 people/ 3-6 BR
7-8 people/ 4-6 BR
9-12 people/ 5-6 BR

I didn't realize number of bedrooms based on family size was enforced. Is that a violation of someones civil rights? Lol. What if all they can afford is a 2 bedroom and they have 2 kids? I can see that happening more and more around here.
