Calm down y'all; I haven't filed a complaint (yet). Despite the opinions here, we have retained a lawyer...an excellent lawyer....because I am fighting fire with fire.

The North Carolina State Bar

Section 5 reads in part:

"A lawyer should conform to the requirements of the law, both in professional service to clients and in the lawyer's business and personal affairs. A lawyer should [not use the law] to harass or intimidate others."

I read elsewhere about this but of course can't find it now.

As to whether the lawyer's conduct is unethical, I think sending an email titled "$xxx.xx or a Lawsuit" is pretty much harassment, intimidation, and extortion. The accusations in the document are flat out lies, or are completely ridiculous.

The LL was in the wrong earlier as well, when he deducted $250. We argued with him about the rotten exterior door (it is the LL's responsibility to check for rot--not the tenant's)...but given that we would have to sue him in the county where he practices it wasn't worth it. Not to mention he threatened us at that time as well along the lines of "if you argue with me I will take full damages".

This guy is a first class you know what. He has already been reprimanded by the NC bar before so I certainly wouldn't be establishing new ground with that.

i agree with what someone else said. Just ignore him and see what happens. Why waste money on a lawyer if he never sues you?

So how much is the lawyer charging you vs. the amount the LL demanded?

If you get a lawsuit, then you deal with it. He isn't going to sue you. He knows he won't win.

This! Never, ever reply through email when the other side is an attorney. Attorney's do this so they have a paper trail of the conversation you have. It may come to haunt you later in court.

$250 lost isn't even worth the effort fighting that scum. Just be glad it's over. Spiders in the windows? Sounds like a nut job.

Walk away and leave him alone. You don't want to go to court and waste time and effort.
