To get the L1A your employer has to want to transfer you, and apply for it. Although the difference between L1A and L1B is the managerial aspect, your immigration lawyer should know about the 'functional manager' option for L1A which allows employees who don't have managerial titles to sometimes qualify for it.
I am under L1 for five year , my work could it sponser me for green card ,there is any ather way i can apply for it my self ? i am married and i have two kids and they are under L2
Your employer has to do it. Make sure they apply for the green card under category EB1C not EB3, if you wait for EB3 you will likely run out of time on your L1 and either have to transfer to H1B (and H4 for your family which sucks) or leave. EB1C processes in a few months currently.
i dont know what the current running time is, but it took us 5 yrs fto go from work visas to green card and some friends of ours who came a few months later 7 years, but we also started the process literlaly just before 9/11 so ive no doubt that didnt help speed the process along.
we had a 5 yr visa and JUSt made it through in time. our frineds ended up gettign an extension without a problem.
No you cant transfer your L1 unless the two companies are legally connected. The only way you can take the new job is if they apply for a H1B which they can't do until April, and which won't start until Oct 1. Once you leave the job and employer specified in your L1 you must leave the country unless you have an approved I130 (the first part of the green card which takes the longest).
I think you will find that L1 goes much quicker than other visa categories.
That's what I thought too.
Is that not how so many IT people (IBM comes to mind) manage to get GCs after 2 years or so?
Come on L1 and then get GC quite quickly. As someone else said it's EB1C they apply for - not EB3 which has the 8 year backlog
An L visa is just easier and quicker. With premium processing it's approved within 14 days, and the spouse can work freely too. Plus if you've managed to qualify under L1A you've done most of the work to show you qualify under EB1C for the green card since the requirements are pretty much the same.
