This is the officer who called for accountability of senior Pentagon officers. He made the statements publicly knowing it would be the end of his military career. But is arresting him and locking him up excessive? This seems to be an act of revenge by senior officer instead of acts appropriate for his actions. While it may be, strictly speaking, within military regulations according to the UCMJ it seems to be an excessive display for the action and words he posted.

The answer is in the post.
Military regulations.
He chose to disregard the procedure for taking it up with his commander. He is a rogue. Defiant and wishing to side step.
His opinions do not reflect the military . His uniform , his title hold him accountable for the standard of conduct . He failed . The 'hearing' article 32 will be his opportunity to share his opinion. And justify how his opinion supercedes all the regulations set forth when being a military officer.

General Milley should be charged with the same thing based upon his call to China without going through proper chain of command and authority.

Evidently he violated an order to refrain from making additional posts on social media. I'm not a Marine but I am a retired Navy Corpsman that served roughly half of my twenty one year career with Marine Corps combat arms units. While I love the Marine Corps I've witnessed that organization eat it's young like no other branch of the military. Confining Lt Col. Scheller to the brig rather than restricting him to the base is designed to send a message out to all those who dare dissent within their ranks.

I’m betting Marine Corps is really going to show its a$$ at his courts martial. This has the potential to become a three ring circus and embarrassment like the general courts martial of Navy SEAL Senior Chief Eddie Gallagher.

Lt Col Scheller should have refrained from posting videos on social media when warned and the Marine Corps likely should’ve let him resign and go as quietly as possible. Maybe Lt Col Scheller has a plan to use his trial to publicize failed policies in Afghanistan OR maybe he’s just a good Marine leader that just had enough.

Ironically, I’m watching the testimonies of SECDEF Austin, General Milley and General McKenzie to the Senate. Their lack of candor is a disgrace.

I applaud him for speaking out in the first place, but take much of that back for the 'follow ups'. Say your piece and resign... good on you. Thumb your nose and continue... not so much.

That said, it'll make his book more interesting.

Wasn’t he just short a couple years from retirement? Poor judgement perhaps.

He was out of line and should be disciplined for being insubordinate, but being put into the brig seems overkill.

When this happened, he said he fully expected to serve time in a military prison. He knew the consequences of his actions.

Yeah, but he also claimed to have resigned his commission, which is not just how the process works. He doesn't seem to be working with a full deck at the moment (perhaps for good reason), so I wouldn't necessarily put much stock into what he has said.

Default Leadership

Interesting congressional hearings to the point of what the Marine was talking about in his video, lack of accountability in General Milley.

Senator Blackburn asked Milley how he had time to leak whitehouse discussions with multiple book authors, on the topic of insulting his bosses, then denying leaking and denying he recommended troops remain in Afghanistan, while saying the U.S. reputation has been “damaged” (his words…).

How can any military leader agree on “a plan” to leave $80 billion in military equipment to the Taliban?

Lesson in Leadership.
